As reported in today’s Concord Monitor, a federal appeals court — calling the jury instructions “overbroad” — yesterday reversed the conviction of James Tobin.

Tobin is a former Republican Party official previously found guilty of participating in his party’s 2002 Election Day phone-jamming conspiracy. The court sent the case back to U.S. District Court in Concord for fresh arguments.

In our story yesterday, we reported that New Hampshire’s Democratic Party planned to ask for an investigation of a delay in prosecuting the case. According to party chair, Kathy Sullivan, New Hampshire Democrats suspect there is a link between the recent firings of eight federal prosecutors and the delay in prosecuting the phone-jamming case.
